Terms and Conditions

Acceptance of Terms and Conditions
Welcome to Wavecast Studios LTD. These Terms and Conditions are entered into by and between you (“you” or “Client”) and Wavecast Studios LTD (“Wavecast Studios,” “we,” or “us”), located at Unit 409, 7015 Macleod Trl SW, Calgary, AB T2H 2K6 (the “Studio”). By making a reservation, entering the Studio, or using our services, you agree to be bound by these Terms and Conditions.
Reservation and Payment
Wavecast Studios rents studio space for podcasting, videography, photography, and related media production. All rentals include the use of studio equipment as provided and staged by Wavecast Studios.
Reservations Made Simple
Reservations are subject to availability and are confirmed only upon receipt of full payment. Full payment is required to confirm your booking. While we do not offer refunds, we are happy to reschedule your booking if sufficient notice is provided and subject to calendar availability.
By completing payment, you waive any right to initiate a chargeback or payment dispute except in cases of proven fraud.
Payment Methods and Deposits
Payment is processed exclusively through the credit card details submitted via the online booking link at the time of reservation. Wavecast Studios does not accept cash, e-transfer, debit, or other forms of payment for bookings. Full payment via the booking link constitutes your deposit and confirms your reservation.
Time Management and Overtime
Your booking time includes setup, recording, breakdown, and cleanup. Access to the Studio is limited to the booked time slot.
If you remain in the Studio beyond your scheduled end time without prior written approval, additional time will be billed in hourly increments at the Studio’s standard rate. Overtime charges may be automatically processed to the payment method on file.
Wavecast Studios is not responsible for delays caused by late arrival of the Client or Invitees. Late arrivals do not extend the booking end time.
Overtime Interference with Other Bookings
Wavecast Studios reserves the right to end a session promptly at the scheduled end time where another booking is scheduled.
When Life Is “Lifing”
We understand that unexpected things happen. If you need to make changes to your booking, you must notify us at least 24 hours in advance of your scheduled start time. No-shows are not eligible for rescheduling. All bookings and associated charges are non-refundable, final, and shall not be disputed once payment is made.
Bookings may be rescheduled by emailing our team at hello@wavecaststudios.com and are dependent on studio availability.
Studio-Initiated Cancellations
In the rare event that Wavecast Studios must cancel or move your booking due to an emergency, equipment failure, or other unforeseen circumstance, we will notify you by email at the address provided during booking. This notice will include an explanation of the issue and a proposed rescheduled time. Wavecast Studios will make reasonable efforts to accommodate your availability when rescheduling.
Studio Rules and Restrictions
Sexually explicit content is strictly prohibited, including but not limited to pornography, nudity, and sexually explicit photography, video, or livestreaming.
Smoking, vaping, alcohol, cannabis, or illegal substances are not permitted anywhere in the Studio.
No minors are permitted on the premises at any time, unless approved by Wavecast Studios Management. For purposes of these Terms and Conditions, a “minor” is any individual under the age of 18.
You are responsible for the conduct of all individuals you invite into the Studio (“Invitees”). You and your Invitees must comply with all posted studio rules, safety procedures, and applicable laws.
Wavecast Studios reserves the right, in its sole discretion, to immediately terminate your session without refund if you or your Invitees violate these Terms and Conditions, studio rules, or any applicable laws.
Consequences of Violation
In addition to immediate termination of your session, any violation of these Terms and Conditions, studio rules, or applicable laws by you or your Invitees may result in cancellation of any remaining session time and/or membership without refund.
Wavecast Studios reserves the right to require you and your Invitees to leave the premises immediately and may refuse future entry or bookings at its sole discretion.
Food and Beverage Policy
Outside food and drinks are not permitted in the Studio. Complimentary coffee and water are provided for your use during your session.
Security and Monitoring
For safety and security purposes, Wavecast Studios may use video surveillance in common areas and studio spaces, excluding washrooms and private changing areas.
Security systems, including access codes and entry systems, are monitored and may be updated regularly. By entering the premises, you consent to such monitoring.
Surveillance footage is stored locally and retained for a period of 30 days, after which it is automatically deleted, except where retention is required for an active investigation, dispute, or legal matter.
Use of Studio and Equipment
The Studio and equipment are provided “as is.” You acknowledge that media production involves inherent risks and voluntarily assume all risks associated with the use of the Studio and equipment.
You are responsible for any damage to the Studio or equipment caused by you or your Invitees. You agree to reimburse Wavecast Studios for the full cost of repair or replacement, plus any applicable service or administrative fees. Charges may be automatically processed to the payment method on file.
Client Equipment
You are responsible for any equipment you bring into the Studio. All electrical equipment must comply with applicable safety standards. Wavecast Studios reserves the right to prohibit the use of equipment deemed unsafe or unsuitable.
Wavecast Studios is not responsible for loss, theft, or damage to Client-owned equipment.
Recording Responsibility
You and your Invitees are solely responsible for confirming that cameras and microphones are actively recording throughout your session, and for bringing the necessary media (such as SD cards) or a laptop with the appropriate software to capture and save your content.
Wavecast Studios is not responsible for any failure to capture video or audio, including but not limited to un-started recordings, full or missing storage media, or software issues.
If an SD card is required and you do not have one, Wavecast Studios may sell you one at the Studio’s standard rate.
Internet Access
Wi-Fi is provided as a convenience. Wavecast Studios does not guarantee speed, uptime, or reliability and is not responsible for interruptions, connectivity issues, or data loss.
Occupancy Limits
The maximum number of individuals permitted in the Studio at any time is determined by the specific studio space and applicable safety regulations. Exceeding occupancy limits without prior written approval may result in immediate termination of the session without refund.
Studio Condition and Cleaning
The Studio must be left in substantially the same condition as it was at the start of the booking.
Excessive mess, spills, stains, damage, or failure to return furniture and equipment to original placement may result in additional cleaning or reset fees. Cleaning fees will be assessed based on the extent of the required work and may be automatically charged to the payment method on file.
Any use of materials that may cause staining, residue, or debris (including but not limited to oils, makeup, glitter, confetti, sand, paint, artificial snow, smoke effects, or open flame devices) is prohibited unless expressly approved in writing by Wavecast Studios.
You authorize Wavecast Studios to charge the payment method on file for any additional fees, including but not limited to overtime, damage, cleaning, or policy violations.
Lost or Damaged Property
Wavecast Studios is not responsible for lost, stolen, or damaged personal property. You are solely responsible for safeguarding your belongings and content.
Intellectual Property and Content
You retain all ownership rights to the content you create in the Studio. Wavecast Studios makes no claim of ownership over your creative work.
You are solely responsible for obtaining all necessary permissions, licenses, releases, and consents for any people, music, artwork, trademarks, or other protected materials appearing in your content.
Wavecast Studios is not responsible for lost, corrupted, or unusable recordings, files, or data.
Marketing, Promotional Use, and No Partnership
With your prior written or electronic consent, Wavecast Studios may capture behind-the-scenes photographs, video, or short clips during your session for promotional and marketing purposes.
By providing such consent, you grant Wavecast Studios a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and share such behind-the-scenes content on our website, social media platforms, and promotional materials.
Wavecast Studios will not use your core production content without separate written agreement.
Consent may be withdrawn at any time in writing for future uses; however, withdrawal will not require removal of materials already published.
Use of behind-the-scenes content does not create any partnership, sponsorship, endorsement, or affiliation between you and Wavecast Studios.
Use of Studio Name and Branding
You may reference Wavecast Studios as the location of your production. However, use of the Wavecast Studios logo, trademarks, or branding in promotional materials requires prior written consent.
Non-Transferability of Bookings
Bookings are not transferable. You may not give, sell, or otherwise transfer your reserved session time, in whole or in part, to any other individual or organization.
Indemnification
You agree to indemnify and hold harmless Wavecast Studios, its owners, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the Studio, equipment, or services, except to the extent caused by our gross negligence or willful misconduct.
You authorize Wavecast Studios to charge the payment method on file for any additional fees, including but not limited to overtime, damage, cleaning, or policy violations.
Insurance
For commercial productions, events, or bookings involving third-party participants, Wavecast Studios reserves the right to require proof of valid public liability insurance prior to the booking date.
Limitation of Liability
To the maximum extent permitted by law, Wavecast Studios shall not be liable for any indirect, incidental, consequential, special, or punitive damages. Our total liability shall not exceed the amount paid for your booking.
Force Majeure
Wavecast Studios shall not be liable for delays or failures caused by events beyond reasonable control, including acts of God, natural disasters, government restrictions, power outages, or emergencies. In such cases, bookings may be rescheduled subject to availability.
Privacy and Data
Personal information collected through our booking system is handled in accordance with our Privacy Policy.
Payment processing may involve third-party providers.
Notices
All official communications, including but not limited to rescheduling requests, cancellations, and notices of policy violations, must be delivered by email using the email address provided at the time of booking. Communications sent through any other channel (such as phone, text, or social media) will not be considered official notice.
Dispute Resolution
In the event of a dispute arising from these Terms and Conditions or your use of the Studio, you agree to first attempt to resolve the matter through good-faith mediation directly with the owner of Wavecast Studios before pursuing any other legal action or remedy.
Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Canada. Any disputes not resolved through mediation shall be resolved exclusively in the courts of the Province of Alberta.
Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Wavecast Studios regarding studio use and supersede all prior agreements. Wavecast Studios reserves the right to update these Terms and Conditions at any time. The version in effect at the time of booking shall apply.
Acceptance of Terms and Conditions
By checking the box during the booking process, completing a reservation, submitting payment, or entering the Studio, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions.
